Draft for review

Terms of Service

Last updated: August 17, 2026

This is a draft under review. It is not yet in effect. Pending.

1. The Agreement

These Terms of Service (these "Terms") are a binding agreement between you and The Lution Company, a Delaware public benefit corporation with its principal address at 201 E Ojai Ave, #660, Ojai, CA 93023 ("Lution," "we," "us," or "our").

These Terms cover everything we offer: our monitoring device, our lab test kits and the analysis behind them, our websites at lutionlevel.com, lutionlabs.com, and lution.ai, our mobile applications, our marketplace, and the results and Lution Levels we deliver. We call all of it the "Services."

We're a public benefit corporation. Our chartered purpose is to make the air inside ordinary homes measurable, understandable, and improvable — for families, not just for experts.

By creating an account, checking the acceptance box we present to you, or using the Services, you agree to these Terms. If you don't agree, don't use the Services.

Section 26 matters. It sends most disputes to individual arbitration instead of court and gives up your right to join a class action. It doesn't apply in Quebec, or anywhere local law says otherwise. Read it before you agree.

Section 13 matters too. We measure your home, not your health. Nothing we tell you is medical advice, and you shouldn't use it to make a medical decision or to put off care.

2. Definitions

A few words we use throughout, defined once so we don't have to keep re-explaining them:

  • "Services" means everything described in Section 1 — the device, the app, the test kits, the lab analysis, the websites, the marketplace, and the results and Lution Levels we generate.
  • "App" means our mobile application(s), however distributed.
  • "Content" means anything you submit to us through the Services — account information, photos, symptom notes, reviews, or messages. It doesn't include the raw sensor data your device transmits or the results we generate for you; Section 22 covers those.
  • "Membership" means a recurring subscription plan described in Section 10.
  • "Lution Level" means our proprietary scoring and interpretation of sensor and lab data for a specific home.
  • "Lution Parties" means Lution and its affiliates, and each of their respective laboratories, suppliers, licensors, service providers, officers, directors, employees, agents, successors, and assigns.
  • "You" means the individual who creates an account or otherwise uses the Services. If you use the Services on behalf of a household, you're confirming you have the authority described in Section 5 for everyone in it.

3. Who Can Use the Services

You need to be 18 and able to enter into a contract.

We offer the Services in the United States and Canada. We don't offer them in the European Economic Area or the United Kingdom, and we don't market to people there.

If you live in Quebec, Section 29 changes some of these Terms for you.

4. Your Account

Keep your information current and your password private. What happens under your account is your responsibility. We may reclaim or change a username that impersonates someone, infringes a trademark, or is otherwise inappropriate.

If you think someone else has gotten into your account, tell us right away at security@lutionlevel.com.

We record which version of these Terms you accepted, when, and what you consented to, so we can both look back at it if we ever need to.

When you register and every time you use the Services, you promise us that the information you give us is true, accurate, and current; that you're at least 18 and can legally agree to these Terms and follow them; that you won't use bots, scripts, or other automated means to access the Services; and that you won't use the Services for any unlawful or unauthorized purpose, or in any way that breaks a law that applies to you. If any of that stops being true, we can suspend or close your account.

5. Your Right to Test the Property You're Monitoring

We measure a physical address. So before you install a device or send us a sample, you're telling us:

  • You own the property, or your lease or another arrangement gives you the right to monitor it and collect samples there.
  • You've gotten whatever permission you need from the people around you — co-occupants, a landlord, a tenant, a property manager, an HOA.
  • You aren't using this to monitor a person without the authorization the law requires.

What you do with your results is up to you. If you use them in a dispute, a sale, an insurance claim, or a court case, that's your decision and your responsibility — including any disclosure you owe as an owner, seller, landlord, or tenant. We aren't part of those matters. We don't write reports for litigation and we don't serve as expert witnesses.

6. Acceptable Use

You agree not to:

  • Break the law with the Services.
  • Claim authority over a property you don't have.
  • Monitor a person secretly or without the authorization the law requires.
  • Use results to harass, defraud, or unfairly disadvantage someone.
  • Pass our results off as your own professional inspection.
  • Reverse engineer our device or software, or try to extract our models, thresholds, or scoring logic.
  • Scrape or bulk-download from the Services.
  • Resell the Services or your results commercially.
  • Build a competing product from the Services.
  • Attack, probe, or work around our security.
  • Submit Content that's unlawful, infringing, defamatory, or that impersonates someone else.

We can investigate and, where we reasonably believe it's necessary, remove Content, suspend accounts, or report conduct to law enforcement.

7. Electronic Communications and Signatures

You agree that we can communicate with you electronically — by email, text, in-app notice, or by posting on our website — and that this satisfies any legal requirement that a communication be "in writing." You agree that clicking "I agree," checking a box, or otherwise completing an electronic acceptance process has the same legal effect as a signature on paper. You can withdraw this consent by contacting support@lutionlevel.com, though if you do, we may not be able to continue providing the Services to you.

8. Purchases, Pricing, and Payment

Prices appear at checkout and don't include shipping or tax unless we say so. Our e-commerce provider handles checkout and payment. We never see your full card number.

The package. The starter package includes one monitoring device, one lab test kit, and one vacuum sampling kit. Its current price appears at checkout before you buy.

Two ways to start.

  • You order from us directly. Your first shipment includes both the test kit and your device.
  • A professional sets you up. You get the test kit first. Your device ships once your sample comes back with a qualifying result. If we never receive a sample, or the result doesn't qualify, we'll tell you your options — including refunding the part of the price that covered the device.

Once you have a Membership, you can buy devices or test kits on their own, change how often we test your home, and shop our marketplace.

When it ships. We ship within 30 days of your order unless we tell you a different date when you buy. If we can't make that date, we'll tell you, give you a revised date, and let you cancel for a full refund. On the professional-setup path, the clock runs from the day your qualifying result comes back.

Errors. If we get a price or description wrong, we may correct it and cancel the affected order with a full refund. We may also limit order quantities or decline an order we reasonably suspect is fraudulent.

9. The Marketplace

Our marketplace offers products we think are worth your money. Some we sell and ship ourselves. Others are sold or shipped by third parties, and we'll tell you which is which before you buy.

For anything a third party sells or fulfills: that company is the seller. Its terms, warranty, and return policy apply, and claims about the product go to them. We aren't the manufacturer and we don't warrant what we didn't make.

We may earn a commission when you buy from a marketplace partner or through a link we provide. We say so where the product appears. It doesn't change what we show you — we'd rather your air got better than that you bought it from us.

10. Membership and Auto-Renewal

Some of what we do requires a Membership. Plans, prices, and billing periods appear at checkout before you buy.

It renews on its own. Your Membership continues at the then-current price for your plan, charged each period, until you cancel. You agree to that recurring charge separately at checkout — its own checkbox, not buried in these Terms.

Cancel whenever. From your account settings, or by emailing support@lutionlevel.com. Cancellation is at least as easy as signing up. It ends at the close of your current period. You keep access until then. We don't prorate.

After you cancel, your device keeps working as a local monitor. What needs our cloud stops: new Lution Levels, trend analysis, and the assistant. Your existing results stay downloadable for 90 days.

If we change the price, we'll tell you at least 30 days ahead. The new price starts at your next renewal, and you can cancel before it does.

Before an annual Membership renews, we'll remind you between 15 and 45 days ahead, with the renewal date, the price, and how to cancel.

Free trials or promotional periods. If we ever offer you a free or discounted period, we'll tell you what it costs afterward, when it changes, and how to cancel — before you agree to anything — and, where the law requires it, we'll remind you before it converts to a paid Membership.

11. Referrals and Credits

Refer someone who joins and you get a credit for a free retest, kit included. They get a discount at checkout. Details are in our Referral Program Terms.

About credits:

  • A credit is good for Lution products and services. It has no cash value.
  • It belongs to your account and isn't transferable.
  • It doesn't expire.
  • It isn't a gift card, a stored-value instrument, or a payment method.

12. Returns, Warranty, and Repair

Returns. 30 days from delivery, unused, in original condition. You cover return shipping. A test kit you've used is consumed — it can't come back. Start a return at support@lutionlevel.com.

Getting it to you. If something is lost or damaged on the way, that's on us until it reaches you.

Installation. Install and use the device only as our instructions describe. Improper installation — including any electrical or structural modification not called for in our instructions — is at your own risk and isn't covered by the warranty below.

Limited warranty. One year from delivery against defects in materials and workmanship. We'll repair it, replace it, or refund it if neither makes sense. Not covered: misuse, accidents, unauthorized modification, use outside the device's rated conditions, improper installation, and ordinary wear.

Rights we can't take away. This warranty adds to whatever your state, province, or country already gives you. Some of those rights can't be waived by contract, and we aren't trying to.

Repair. We make replacement parts, tools, and repair documentation available as the law requires, on fair and reasonable terms.

13. Not Medical Advice

We measure your environment. We tell you what our sensors and our labs found in the air and dust of a specific place at a specific time. That's the job, and we take it seriously.

Here's where the line is.

Our results are not medical advice. Lution is not a medical device, diagnostic test, healthcare provider, or clinical lab, and the Services do not diagnose, treat, cure, or prevent any disease or condition. Do not use or rely on sensor readings, sample results, Lution Levels, or automated responses to make medical decisions or to delay or replace professional care. Consult a qualified healthcare professional about symptoms, exposure concerns, or health decisions, and seek emergency assistance for an urgent medical condition.

If you share health information with us, we don't interpret it. Some people choose to tell us about symptoms in their household. We use that only as our Privacy Policy and Consumer Health Data Privacy Policy describe. We don't read it back to you, act on it, or tell you what it means.

We don't tell you how to fix your building. No repair plans, no scopes of work, no contractor picks. Our results aren't a remediation plan or an inspection report. That work belongs to a qualified professional.

We're not an inspection or a certification. We don't certify a home as safe, healthy, habitable, or clear of anything. We're not a substitute for a building inspection, an industrial hygiene assessment, or any inspection a law or a transaction requires.

We don't endorse other people's products. Where we show them, we're offering options, not guarantees. Section 9 covers who's responsible for what.

14. Understanding What Your Results Can and Can't Tell You

We'd rather you understand the instrument than trust it blindly. Every measurement has an edge, and here's where ours are.

Sensors have tolerances and floors. Each one has a margin of error and a level below which it can't detect. Current figures live in the technical specifications on our site, which we update as our hardware changes.

Some readings are indexes, not concentrations. Where we report volatile compounds and nitrogen oxides, those are relative index values measured against a rolling baseline for your home — not parts per billion, not comparable to another house. The sensing responds to a family of gases without identifying which one, so nail polish, a cleaning spray, or a glass of wine can move it sharply without anything being wrong.

Conditions shift what a sensor sees. Humidity, temperature, ventilation, and how tightly your home is sealed all affect readings. Some sensors calibrate themselves against assumptions about your home — like periodic exposure to outdoor air — and those assumptions don't hold everywhere.

Particle readings measure mass, not identity. They can't tell searing steak from candle soot from drywall dust.

Some values are calculated, not measured. Airflow and filter condition are inferred from other readings. Treat them as estimates.

Coverage isn't continuous. The device needs power and internet. Outages leave gaps, and we don't promise unbroken monitoring.

The lab

Independent accredited labs run your samples, and we may change labs. Their methods have edges too.

  • Sequencing tells you relative abundance — proportions within your sample, not absolute amounts — unless we say quantification controls were used.
  • It reads genetic material, which doesn't distinguish living from dead. Residue from growth that ended years ago still shows up. A detection is not proof of active growth.
  • Not everything resolves to a single species. Some results stop at a broader group.
  • Results describe the surface you sampled, at the moment you sampled it, and how you collected matters a great deal.
  • Finding nothing isn't proof of nothing. A source inside a wall, under a floor, or deep in a duct can stay hidden.

Lution Levels. These are our reading of the data — a considered interpretation, not a regulatory limit. For most indoor biological contaminants, no scientific or regulatory consensus on a safe level exists. That gap is why we built this. Severity labels describe the space, never a person.

Comparisons to other indices. Where we report something modeled on a published industry index, that number is our estimate by our methods. It isn't that assay, wasn't produced by the lab that offers it, and shouldn't be compared to a result issued under that name.

The assistant. It's generated by automated systems, including AI from a third party. It can be wrong. It describes what we measured. It won't tell you what your results mean for anyone's health and it won't give you remediation instructions. Don't make it your only source.

15. Samples and Lab Testing

Collect the way the instructions say and ship the way we direct — results depend on it.

If a sample is lost, damaged, or unreadable — in transit, at the lab, anywhere — we send you a new kit, free. That's the whole remedy. We aren't responsible for the delay, for your time collecting again, or for anything that follows from not having the result.

Turnaround times are estimates.

The sample itself. Testing consumes it. When you send us a sample, you're giving us and our labs permission to process, analyze, and use it up for the testing you ordered. We don't return samples. Whatever remains is destroyed within 90 days of analysis, and our labs may not use your sample or your results for their own purposes.

We don't test it for anything else. We look for what's in your environment. We don't perform genetic testing on people, we don't try to identify any individual from a sample, and we don't use your sample for research or product development unless you separately tell us we can.

What not to send. Just send ordinary household dust and surface material, collected the way the kit describes — nothing else. Don't send anything hazardous, medical, biohazardous, or restricted from shipping. If a sample reaches our lab in a condition it can't safely handle, we'll discard it and send you a new kit.

16. Your Device, Our Software, and Updates

Software is licensed, not sold. You get a limited, personal, non-commercial, non-transferable license to use our firmware and apps with your Lution device. We keep everything else, subject to Section 17.

We may update the software remotely. You authorize us to remotely install or push firmware, software, security, configuration, and app updates automatically, including updates that add, modify, replace, or remove features, to maintain security, reliability, compatibility, legal compliance, and the Services. You must install any app update we designate as required, and older versions may stop working; where required by law, we will give notice or obtain consent before an update that materially reduces paid functionality.

The device needs power, internet, and our cloud to do what we describe. Your network and your electricity are yours.

Changes to the Services. We may modify, suspend, or discontinue any part of the Services, including cloud features your device relies on. Where a change would materially reduce what your device does, we'll give you reasonable advance notice and a way to export your data.

Passing it on. Your history lives with your account, not with the building. Factory reset a device before you hand it over and reassign it in your account — the next owner starts clean, with no view into your data. If you move, you can delete a former address and its history from your account.

Open source. Our software includes open-source components. Notices and license terms are in Open Source Notices on our site.

17. Mobile Application License Terms

This Section applies to your use of the Lution mobile application (the "App"), in addition to Section 16 above, which continues to apply. If you access the Services only through our website, this Section doesn't apply to you.

17.1 License Grant

Subject to your compliance with these Terms, Lution grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a mobile device you own or control, solely for your personal, non-commercial use in connection with the Services, and solely in accordance with these Terms and the usage rules of the app store or platform through which you obtained it.

You may not: (a) copy, modify, or create derivative works of the App; (b) reverse engineer, decompile, or disassemble the App, except to the extent applicable law doesn't allow that restriction; (c) rent, lease, lend, sell, redistribute, or sublicense the App; or (d) remove or obscure any proprietary notices on the App.

17.2 Platform-Specific Terms

Depending on the mobile platform and app store through which you obtained the App, the following additional terms apply, as applicable.

(a) If you downloaded the App from the Apple App Store:

  • This Agreement is between you and Lution only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
  • The license above is limited to use on an Apple-branded product that you own or control, and as permitted by the App Store's Usage Rules in Apple's Media Services Terms and Conditions.
  • Apple has no obligation whatsoever to furnish any maintenance or support services for the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are Lution's sole responsibility.
  • Apple is not responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy, or similar law.
  • If a third party claims that the App, or your possession and use of it, infringes that party's intellectual property rights, Lution — not Apple — is solely responsible for investigating, defending, settling, and discharging that claim.
  • You represent that you're not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as "terrorist supporting," and that you're not on any U.S. Government list of prohibited or restricted parties.
  • You must comply with any applicable third-party terms when using the App, such as your wireless data service agreement.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms as they relate to your use of the App, and Apple has the right to enforce them against you as a third-party beneficiary.

(b) If you downloaded the App from the Google Play Store:

  • This Agreement is between you and Lution only, and not with Google LLC or its affiliates ("Google"). Google is not a party to this Agreement and is not responsible for the App or its content.
  • Your use of the App must also comply with Google Play's then-current Terms of Service and applicable policies. To the extent of any conflict between those terms and these Terms with respect to your relationship with Google — as opposed to Lution — Google's terms govern that limited relationship.
  • Google has no obligation to provide maintenance, support, or warranty services for the App. Any warranty or product liability claims relating to the App are Lution's responsibility, not Google's, to the fullest extent permitted by law.
  • Google is not responsible for addressing any claims by you or a third party relating to the App, including claims of intellectual property infringement or claims under consumer protection, privacy, or other applicable law. Lution is solely responsible for such claims as between you, Lution, and Google.
  • You represent that your use of the App complies with all export control and economic sanctions laws applicable to you.

17.3 General

Lution's contact information for questions, complaints, or claims regarding the App is: The Lution Company, 201 E Ojai Ave, #660, Ojai, CA 93023, legal@lutionlevel.com. Nothing in this Section limits any other provision of these Terms, including the disclaimers in Section 13, the warranty in Section 12, and the disclaimers, liability limits, and dispute resolution terms in Sections 23 through 28.

18. Automated Results and Our Assistant

Lution Levels and assistant responses are generated automatically — by algorithms and, for the assistant, automated systems including AI technology from a third party — without a person reviewing each one individually.

If a decision that affects you is made solely through automated processing and applicable law gives you a right to a human review, contact support@lutionlevel.com and we'll have a person look at it.

21. Intellectual Property

Lution and Lution Level are our trademarks. Our methodology, scoring engines, reference data, report formats, and product design are protected by copyright, trade secret, patent, and other law. These Terms give you nothing in them beyond the licenses in Sections 16 and 17.

22. Your Data

Our Privacy Policy and, if you share health information, our Consumer Health Data Privacy Policy are part of these Terms. Read them — they're written to be read.

Your results are yours. You own your account and the results we generate for you. You can share them with anyone you choose — a physician, a mold inspector, an HVAC contractor, a family member.

Running the Services. You keep your rights in the Content you submit and your raw sensor data. You give Lution a limited, worldwide, royalty-free license to host, process, analyze, and share that Content and data with our labs and service providers only as needed to provide, operate, secure, and improve the Services or comply with law. Lution owns its software, models, and de-identified or aggregated insights, and we keep your Content and raw sensor data only as long as needed for those purposes or as required by law.

Research and model improvement — and your choice about it. We also use your data, de-identified and aggregated, for research on indoor environments, for publishing findings, and for training and improving the models behind our Services.

When we say de-identified, we mean it. We take reasonable measures to keep de-identified data from being connected back to you, we commit to keep and use it only in de-identified form, and we require anyone we give it to do the same.

You can opt out of it. One setting in your account, labeled Research and Model Improvement, covers both. Turn it off and we stop including your data in research datasets and model training going forward. Everything else keeps working exactly the same, and we won't charge you differently or treat you differently for it.

One honest limit: we can't pull your contribution back out of research already published, datasets already aggregated, or models already trained. De-identified data stops being findable as yours, which is the point of de-identifying it. Opting out is forward-looking.

Health information sits outside all of this. We collect it only with your separate opt-in, it's governed by the Consumer Health Data Privacy Policy, and we don't sell it. You can withdraw that consent whenever you want.

Lines we won't cross. Everyone who receives data from us is contractually barred from using it for insurance underwriting or pricing, credit decisions, tenant screening, employment decisions, or any adverse action against a person or household. Your air quality will never be used against you.

Backups and export. We back up routinely, but no system is perfect and we can't promise data is never lost. You can export your results at any time, and it's worth keeping your own copy of anything you rely on.

Feedback. Tell us what you think and we may act on it, freely and without owing you anything.

23. Disclaimer of Warranties

Apart from the warranty in Section 12, and except where the law doesn't allow it, the Services come "as is" and "as available," and we disclaim all warranties — express, implied, and statutory — including merchantability, fitness for a particular purpose, title, and non-infringement. We don't promise the Services will be uninterrupted, error-free, or secure, or that results will be complete.

The device is the exception. Because Section 12 gives you a written warranty on the device, we don't disclaim the implied warranties that come with it. We limit them to the one-year duration of that written warranty, and only where the law allows. Some states and provinces don't allow limits on how long an implied warranty lasts, so that limit may not apply to you.

What we aren't disclaiming. Nothing in this Section limits any warranty or consumer right that the law will not let us disclaim, including for fraud, willful misconduct, gross negligence, or death or personal injury caused by negligence.

24. Limitation of Liability

To the maximum extent permitted by applicable law, the Lution Parties will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, property damage, remediation costs, loss of property value, a lost transaction, business interruption, or damages resulting from reliance on or inability to obtain results, under any legal theory and even if advised that such damages were possible.

To the maximum extent permitted by applicable law, the Lution Parties' aggregate liability for all claims arising from or relating to the Services will not exceed the amount you paid us for the specific product or Service giving rise to the claim.

What we aren't limiting. Nothing in these Terms limits liability or statutory consumer rights that the law will not let us limit, including for fraud, willful misconduct, gross negligence, or death or personal injury caused by negligence. If local law limits any term in this Section, that law controls, and the term applies only to the maximum extent permitted by applicable law. All other protections in these Terms remain in effect.

25. Indemnification

To the extent permitted by applicable law, you will defend, indemnify, and hold harmless the Lution Parties from third-party claims, damages, judgments, penalties, and reasonable legal fees arising from your material breach of these Terms, misuse of the Services, violation of law or another person's rights, lack of the authority or permissions required by Section 5, or unauthorized use or disclosure of results, except to the extent caused by an indemnified party's negligence or willful misconduct.

26. Dispute Resolution

26.1 Talk to Us First

Before anything formal, write to legal@lutionlevel.com or our address above, describing the problem and what you want. We'll do the same for you. Both of us negotiate in good faith for 60 days. This step comes before arbitration, and the clock on any deadline pauses while it runs.

26.2 Arbitration

If 60 days doesn't resolve it, you and we agree that disputes about these Terms or the Services go to binding individual arbitration with the American Arbitration Association under its Consumer Arbitration Rules — not to court. The arbitrator decides questions about this Section's scope and enforceability, except as Section 26.5 provides.

Arbitration happens in your county, by video, or on the documents — your choice. The arbitrator can award anything a court could award you individually.

We pay the AAA's filing and arbitrator fees for your claim to the extent its Consumer Arbitration Rules require, and we won't ask you to pay our attorneys' fees unless the arbitrator finds your claim frivolous.

26.3 Class Action Waiver

Claims go forward individually. Neither of us can bring or join a class, collective, consolidated, or representative action, and the arbitrator can't combine other people's claims or run a representative proceeding.

26.4 Many Similar Claims at Once

If 25 or more similar demands are filed against us through the same counsel or a coordinated effort, they proceed in sequential batches of up to 50, one arbitrator per batch, with deadlines paused for everyone still in the queue.

26.5 Opting Out, and What's Excluded

You can reject arbitration. Email legal@lutionlevel.com within 30 days of first accepting these Terms with your name and a sentence saying you opt out. Nothing else changes.

This Section also doesn't cover small claims court, claims for injunctive relief protecting intellectual property, or any claim or remedy the law says can't be arbitrated or waived — including public injunctive relief.

26.6 If Part of This Doesn't Hold

If the class action waiver fails for a particular claim or remedy, that piece goes to court and the rest of this Section still governs everything else. If the waiver fails entirely, this Section doesn't apply and Section 27 does.

26.7 Quebec and Elsewhere

This Section doesn't apply in Quebec, or anywhere else law prohibits mandatory arbitration or class action waivers in consumer contracts. Section 27 applies instead.

27. If Arbitration Doesn't Apply

You and we each give up the right to a jury trial, and each give up the right to bring or join a class, collective, consolidated, or representative action. These stand on their own and survive if Section 26 doesn't hold — except where the law says they can't.

28. Time Limit to Bring a Claim

Bring any claim within one year of when it arises, or it's barred — unless the law gives you longer. This Section doesn't apply in Quebec.

29. Canada and Quebec

We follow the Personal Information Protection and Electronic Documents Act and applicable provincial privacy law. We send commercial email and texts only with the express consent Canada's Anti-Spam Legislation requires, and every message has an unsubscribe. Provincial rules on distance contracts, including any statutory cancellation period, apply to your purchase, and Section 12 doesn't limit them.

Automated results. If a result is produced by automated processing, you can ask us for the reasons behind it and submit observations for a person to consider. Write to support@lutionlevel.com.

If you live in Quebec: Sections 26, 27, and the one-year deadline in Section 28 don't apply to you. Quebec's statutory warranties — including the warranty of good working order and of fitness for purpose — apply fully, and Section 12 doesn't limit them. We won't unilaterally change an essential term of this contract. You're entitled to these documents in French, and a French version is on our site. Les parties conviennent que les présentes conditions et tous les documents s'y rattachant soient rédigés en français et en anglais.

30. Accessibility

We work toward WCAG 2.1 Level AA. If something on our site or in our app blocks you, write to support@lutionlevel.com and we'll get you what you need while we fix it.

31. Changes to These Terms

Small changes: we post the updated Terms with a new date and tell you at least 30 days ahead.

Changes that matter — price, how disputes get resolved, our liability, or your right to cancel — take effect at least 30 days after we tell you. Keep using the Services after that and you've accepted them. If you'd rather not, cancel before they take effect and we'll refund the unused part of what you prepaid.

New uses of sensitive information work differently. Before we use health information or your precise location for anything beyond what we described when we collected it, we ask for your separate opt-in. Say no, or say nothing, and your service continues exactly as it is — we simply don't apply the new use to you.

Where law prohibits unilateral changes to essential terms, we won't make them.

32. Suspension and Termination

Stop whenever you like, and close your account from your settings.

We may suspend or end your access to all or part of the Services, with or without notice, if you breach these Terms, if the law requires it, or if we reasonably determine that continuing would create a risk of harm or liability. We may also discontinue the Services generally.

If we close your account for breaking these Terms, don't open another one — under your name, a made-up name, or someone else's — unless we agree in writing.

Sections 5, 13, 14, 17, 20, 21, 22, 23, 24, 25, 26, 27, 28, and 33 survive termination.

33. General Provisions

Force majeure. Neither of us is responsible for delays caused by things outside reasonable control — disaster, fire, epidemic, labor dispute, government action, war, carrier or utility failure, or component and lab capacity shortages.

Assignment. You need our written consent to assign these Terms. We may assign them to an affiliate or in a merger, acquisition, reorganization, or asset sale.

Severability. If a provision can't be enforced, it gets narrowed or removed as little as necessary, and the rest stands.

No waiver. Not enforcing something once doesn't mean we've given it up.

Governing law. California law, without its conflict-of-laws rules, plus applicable U.S. federal law. Where Section 26 doesn't apply, the state and federal courts in Los Angeles County have exclusive jurisdiction, and we both agree to it. Nothing here takes away a consumer protection right your own state, province, or country gives you that can't be waived. Where such a law conflicts with these Terms, it wins.

Entire agreement. These Terms, the Privacy Policy, the Consumer Health Data Privacy Policy, and any program-specific terms we post or show you — including our Referral Program Terms — are the entire agreement about the Services.

Notices. We'll email you or post on the site. Reach us at The Lution Company, 201 E Ojai Ave, #660, Ojai, CA 93023, or legal@lutionlevel.com.

Sanctions. You confirm you aren't in an embargoed country and aren't a person U.S. persons are barred from dealing with.
